At MassLandlords we emphasize the positive can-do. But we also need to teach the full life cycle of rental real estate ownership, including asset reallocation, down-sizing, and possibly even selling out. Even if you are committed to holding your properties through the pandemic (we hope you are), it’s good to know your options.
This presentation will start with a quick recap of Section 1031 exchanges, which can be used to sell your current rental real estate without paying capital gains tax. You can switch your portfolio from eviction-moratorium residential to commercial, or raw land. You can keep operating residential but move your entire portfolio a short drive across state lines. You can even get a passive replacement, like a stock, but something that leverages your decades of real estate experience. We’ll talk about Delaware Statutory Trusts, Real Estate Investment Trusts, and tenants in common.
Note that this is not our repertoire “Section 1031 Exchanges” presentation. This presentation is specific to asset reallocation and will only give a brief 1031 overview.

Come learn about screening renters who receive public assistance, including unemployment. Can you refuse to rent to someone who is on unemployment? Not for that reason.
We’ll begin by reviewing federal and Massachusetts discrimination protections. Included in the list of Massachusetts protections is receipt of public assistance. What counts as public assistance? We’ll consider Section 8, SSI/SSDI, SNAP, unemployment, and state pensions.
Then we’ll look at the math. How does Section 8 guarantee a renter will pass an income screen? Can federal and state unemployment add up to less than what is required? Can you reject an application the basis of income in either scenario? Attendees will leave with a detailed understanding of this important discrimination protection and how to know whether rent is likely to be paid by an applicant.
This part of the presentation will be given by trainers from the Massachusetts Commission Against Discrimination. Staff trainers will be providing legal information but will not be giving advice specific to your situation.

The eviction moratorium may have made sense from a public health point of view back in March, but without any funding the same tidal wave of evictions is still coming, only later. At least a year’s worth of cases will be filed the week the moratorium ends. And cumulative arrearages the last three months have been 19%, meaning potentially hundreds of millions of dollars would have to be paid to keep every renter out of court. What can be done?
This webinar will review our Fair and Equal Housing Guarantee via Surety Bonds. We will review the basic concept of a housing guarantee, and the key players needed to make it work. Landlords, renters, surety bond companies, and the Commonwealth must all work together. Then we will discuss mechanics of how landlords can get the bond, what they can or cannot do while holding a bond, and how they can get repaid. Finally, we will look at mechanisms for funding surety.
Attendees will leave with a better understanding of the talking points, prepared for advocacy with your representative and senator and others in the community.
This part of the presentation will be given by Peter Vickery of Bobrowski & Vickery, LLC. Attorney Vickery practices law in Western Massachusetts where he focuses on landlord-tenant law (representing landlords in Housing Court) and discrimination defense (representing business owners in the Massachusetts Commission Against Discrimination). He graduated from Oxford University (Jesus College) with a BA in Modern History; obtained his Post-Graduate Diploma in Law from the University of the West of England in Bristol; his JD from Boston University School of Law; and his Masters in Public Policy & Administration from the University of Massachusetts, Amherst. Attorney Vickery served one term on the Governor’s Council (the elected 8-member body that approves or vetoes the governor’s choice of judges in Massachusetts) and on the State Ballot Law Commission. As Legislative Affairs Counsel for MassLandlords he drafts bills, bill summaries, and testimony in the area of housing law, and writes amicus briefs in cases that have strategic significance for rental-property owners.
