Matt Pelrine of North Star Insurance will be addressing a variety of surprises including vacancy insurance, errors and omissions for managers, and coverage to bring your building back up to code after a loss.     If you do an Internet search of “Massachusetts lead paint laws”, among the first results will be advertisements warning of lead paint hazards. For instance:

    • Be safe!
    • Make your home safe again.
    • Protect your family’s health.
    • Even the tiles in your home can contain lead paint.

    Whether justified or not, elevated levels of lead in a child are often deemed to be the fault of the landlord. We are especially vulnerable to civil suits and must be vigilant of changes and updates to lead paint regulations. It’s complicated, but fortunately we have Mary.

    Mary Chabot is a longtime member of SWCLA. She has been teaching deleading to landlords for more than 17 years. In addition to being an instructor on the topic, she is also a landlord who – along with her husband, George – has successfully deleaded all of her own rental units.

    Following Mary’s update on new lead law legislation, there will be ample time for questions and comments.

    To provide some background on the subject, this issue of your newsletter is devoted to information on lead paint regulations in Massachusetts. Because some online resources do not always provide publication dates, some of the information enclosed might not be current. Mary, as a certified instructor on the topic, keeps up to date on this issue and is often ahead of any information provided on the Internet.

    To guard against inadvertent violations of the law, as well as protecting ourselves against liability, this month’s topic is of great importance to the Massachusetts landlord.

    Legally Avoiding Paying Taxes

    2017 is over and it’s time to think about taxes. Do you qualify for the real estate professional exemption? Is your current legal entity or lack thereof the best you can do? Most importantly, how can you legally avoid paying tax? We’ll be diving into depreciation, segregation studies, and recapture so that you can either DIY or better supervise your accountant.     Take note, last-minute changes due to Trump Tax Reform!

    The locally famous John Fisher, author of the Rental Housing Manual and landlord-advocate at Wayfinders, will be traveling to Washington, DC.
    In his place will be his colleagues from Wayfinders (Julio Cordero, Chris Montemayor, Cheryl LaChance and Charles Goddard), to talk about the differences between HAP and Wayfinders. We’ll also be explaining the difference between Section 8 and MRVP subsidy programs, and more.

    We’ll end with a longer segment based on what we’ve learned of Trump tax reform. The key message will be how to use lines of credit to become a cash buyer in a hot market. Andrew Komarow of Talcott Financial will be walking us through this simple process. Generally, you can get a large, un-collateralized line of credit based on your business tax returns.

    Most importantly! We’ve learned that Trump tax reform is giving many of us reasons to re-assess how we own our property. S-corp owners take note, you may not be eligible for the
    pass-through deduction advertised! Also note that even if you don’t have an S-corp, there are things you can take advantage of.
