  • Southbridge Virtual Meeting Mon Feb 1: The Tenant’s Right of First Refusal

    A tenant’s right of first refusal means that when a landlord wants to sell a rented property the tenants must first be informed and then given the right to purchase the property before it can be sold to any other party.

    A bill from the Massachusetts state legislature enacting this concept into law was vetoed by Governor Baker in mid-January; the issue therefore is moot – at least for now. However, tenant’s rights advocates will probably be working to put this on the agenda for the new legislative session.

    That being the case, it will be helpful for all of us to have the concept explained in detail from a legal standpoint, the impact such legislation might have on the small-time landlord, and the ripple effects such a law might have on the affordable housing market and the real estate industry in general.

    Attorney Jordana Roubicek Greenman has a deep knowledge of housing court procedures and is well-respected for aggressively advocating for clients’ goals. In addition to being a mentor for landlord / tenant law, she is member of both the Real Estate Council for the Mass. Bar Association and the Real Estate Bar Association for whom she is a frequent speaker. Attorney Greenman has been awarded “Rising Star” designation in Super Lawyers magazine, is a columnist for Massachusetts Lawyers Journal and Real Estate Bar Association News, and regularly leads legal seminars for first-time homebuyers and small property owners.

  • Statewide Virtual Meeting Wed Feb 3: Bills for the 192nd Session

    This presentation will be a line-by-line review of selected bill
    text
    MassLandlords intends to file or has filed this 192nd
    legislative session. The two-year session started January 2021.

    We will start by reviewing the Policy Priorities Survey, which sets
    member direction. We will zero in on those priorities we believe
    can best be achieved by legislative means (some priorities can best be achieved
    in other ways). Some bills will not be directly tied to the survey
    and instead will be foundational in nature.

    Most of the presentation will be focused on a select set of
    bills. We will review line-by-line the purpose and meaning. As we
    go, we will teach some of the requirements of legislative drafting.

    Attendees of this presentation will leave with a deeper
    understanding of how bills are drafted, which bills we have filed
    and why, and how future progress can be made in the legislature.

    This part of the presentation will be given by Peter Vickery of Bobrowski
    & Vickery, LLC. Attorney Vickery practices law in Western Massachusetts where he focuses on landlord-tenant law
    (representing landlords in Housing Court) and discrimination defense (representing business owners in the Massachusetts Commission Against Discrimination).
    He graduated from Oxford University (Jesus College) with a BA in Modern History; obtained his Post-Graduate Diploma in Law from the University of the
    West of England in Bristol; his JD from Boston University School of Law; and his Masters in Public Policy & Administration from the University of Massachusetts,
    Amherst. Attorney Vickery served one term on the Governor’s Council (the elected 8-member body that approves or vetoes the governor’s choice of judges in Massachusetts) and on the State Ballot Law Commission. As Legislative Affairs Counsel for MassLandlords he drafts bills, bill summaries, and testimony in the area of housing law,
    and writes amicus briefs in cases that have strategic significance for rental-property owners.

Since then, Dana and his wife have purchased and sold rental properties around the Metro West area. They now have 9 Units in Watertown and Marlborough.     This presentation will be all about indoor air quality, meaning “is the air in our apartment safe to breathe long-term?” You may be surprised by what the science says. This presentation will examine:

    • Why indoor air quality matters to us and our renters
    • Common causes of poor indoor air quality
      • Environmental tobacco smoke
      • Pests
      • Excess moisture/dampness/mold
      • Volatile organic chemicals (VOC)
      • Carpets
      • Gas stoves
      • Radon
    • Steps proactive landlords can take to create healthier homes for our residents

    This presentation will not go into legal specifics on which landlords have been sued for indoor air quality and what the penalty was. You can take it from us that this is a growing exposure for housing providers.

    Monitoring for indoor air quality is fun! Invisible substances become visibly measurable with the right tools. Small changes in the way we operate can make big improvements in how we think, feel, and breathe in our homes.

    Professor David Turcotte, University of Massachusetts Lowell

    Part of this presentation will be given by Professor Dave Turcotte, Sc.D., research professor, director, and principal investigator at the New England Consortium at the University of Massachusetts Lowell and Lowell Healthy Homes Program. Professor Turcotte researches healthy homes and sustainable housing. He is currently studying HEPA filters as intervention for renters with asthma and/or chronic obstructive pulmonary disease. He has authored dozens of papers and given many more presentations on indoor air quality, particularly as it applies to rental housing.

  • Virtual Meeting Thu Feb 11: Service/Support Animal/Pet Training and Requirements

    In this presentation we will review service animals, emotional support animals, and pets. We will compare and contrast the different roles and needs of each. And we will establish the lines housing providers cannot cross when conducting needed background checks on animals and renters with animals.

    We will answer the following questions:

    • Why do we need to allow service animals and emotional support animals?
    • How can I screen a renter household and/or their animal?
    • What’s the penalty for crossing the line or making a mistake?
    • How should I approach the conversation when a current or prospective renter requests to have an animal?
    • How can I deal with a bitey, barky, or jumpy animal that doesn’t seem like a valid request?
    • Can I request a renter animal have vaccinations? Be leashed? Go to training?

    We will review the Canine Good Citizen program and the practical realities of providing housing to renters with service dogs, emotional support animals, and pets.

She has years of experience training service dogs and helping both renters and landlords understand rights and responsibilities under the Americans with Disabilities Act. Cheyenne is a certified dog trainer and an American Kennel Club evaluator for the AKC STAR PUPPY, CGC, CGCU, CGCA, certified k9 fitness instructor and AKC trick dog titles. She has over 8 years of experience and has trained thousands of dogs.

Having worked in high level IT his whole life he looks at things from a different perspective which he applies to real estate.     Our February 2021 Special Guest Speakers is Dr. Alicia Wasula, President of Shade Tree Meteorology, LLC.

    The Shade Tree Meteorology team provides a range of custom services, tailored to the unique needs of each client. Professional meteorologists with extensive experience issuing forecasts and radar-based severe weather warnings translates into exceptional skill at reconstructing weather events as a weather expert witness. Clear, non-technical (but scientifically sound) explanations of the what, where, when and why in thunderstorm events, flooding events, and winter storm events have proven extremely useful to clients in pretrial and courtroom testimony.   • Statewide Virtual Meeting Tues Feb 16: Policy Forum Lite

    This presentation and discussion will be focused on housing policy, with particular emphasis on the housing provider perspective. This virtual event is a condensed version of what used to be the half-day on-site held at the Southbridge Hotel and Conference Center, near the geographic center of Massachusetts. Participation is encouraged but not required.

    We will start with a condensed recent history of housing policy in Massachusetts, as seen from a housing provider’s perspective.
    We will start primarily in January 2020 and review the changing emphasis of the pandemic, including policy successes and failures that have occurred since:

    • Certification
    • Jail time for landlords
    • Multiple layers of eviction moratorium
    • CARES Act
    • Rent cancellation
    • HEROES Act
    • Infinite moratorium
    • Eviction diversion initiative
    • RAFT moratorium
    • Ranked choice voting
    • Right of first refusal and eviction sealing

    At the conclusion of the presentation, we will discuss what may lie over the horizon, what housing providers need to do to prepare, and where we go from here. Please note: this is not a detailed how-to comply with the various laws, this is a policy discussion.

    This presentation will be given by Doug Quattrochi, Executive
    Director, MassLandlords, Inc. Doug was a founding member of MassLandlords in 2013. He became the association’s first Executive Director under new bylaws in 2014. Since then, he has scaled the organization from a core of 160 members in Worcester to approximately 2,000 dues paying businesses from Pittsfield to the Cape, and from an all-volunteer team to approximately 20 full and part-time staff plus 50 volunteers. Doug has been instrumental in advancing democratic governance mechanisms, including score voting for policy priorities and a staggered and democratically elected Board of Directors. Doug also oversees the RentHelper spin-off, which is expanding access to electronic banking for those of us who are unbanked or underbanked. Prior to MassLandlords, Doug held leadership roles in various Massachusetts startups, two of which are still operating. Doug holds a Master of Science in Aerospace Engineering from the Massachusetts Institute of Technology.

  • Webinar Fri Feb 19: Heat Pump vs Furnace Calculator

    This webinar will present an overview of the MassLandlords “heat pumps vs furnace” calculator,
    available to members online. Attendees will leave with the ability to select the best heating system for retrofits and new construction. We will focus on operating costs only. This presentation will be heavy on Excel and the basic math about whether heat pumps
    can be cheaper than natural gas to operate. The answer is yes, heat pumps can be cheaper than natural gas! But poorly chosen heat pumps can be more expensive and far less effective. This presentation will focus on heat pump selection and understanding the tradeoffs involved in this new technology. The basic math will apply to air source heat pumps. The spreadsheet can be modified to model a ground source heat pump.

    This will not be a detailed discussion about heat pump installation and maintenance. The presenter is not a licensed installer. A future meeting will discuss installation, which can be much more expensive than natural gas especially in retrofits.

    We will review recommended rental property monetizations for carbon-neutral technology.

    This presentation will be given by Doug Quattrochi, Executive
    Director, MassLandlords, Inc.
    Doug was a founding member of MassLandlords in 2013. He became the association’s first Executive Director under new bylaws in 2014. Since then, he has scaled the organization from a core of 160 members in Worcester to over 2,000 dues paying businesses from Pittsfield to the Cape, and from an all-volunteer team to approximately 20 full and part-time staff plus 50 volunteers. Doug has been instrumental in advancing democratic governance mechanisms, including score voting for policy priorities and a term-limited and democratically elected Board of Directors. Doug also oversees the RentHelper spin-off, which is expanding access to electronic banking for those of us who are unbanked or underbanked. Prior to MassLandlords, Doug held leadership roles in various Massachusetts startups, two of which are still operating. Doug holds a Master of Science in Aerospace Engineering from the Massachusetts Institute of Technology.
